1. Who you are contracting with

Medifest is operated by Simranjit Singh Bhinder ("Medifest", "we", "us"). These Terms form the agreement between you and Simranjit Singh Bhinder for your use of the Medifest website and applications (the "Service"). If you are using Medifest on behalf of an organisation, you confirm you have authority to bind that organisation; otherwise you confirm you are of legal age to enter this agreement.

2. Acceptance

By creating an account, subscribing, or continuing to use the Service you agree to these Terms. If you do not agree, please stop using the Service.

3. The Service

Medifest provides guided meditations, soundscapes, breathwork, sleep content, visual meditation, journaling and related wellbeing tools. Medifest is for general wellbeing only and is not medical advice, diagnosis or treatment. Always consult a qualified health professional about medical or mental health concerns.

4. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.

5. Acceptable use

You must not misuse the Service. In particular you must not:

  • use the Service for any unlawful purpose;
  • engage in fraud, spam, harassment or abusive behaviour, including in community and chat features;
  • infringe anyone's intellectual property or privacy rights;
  • interfere with security — including introducing malware, probing or scanning our systems, scraping, or circumventing technical or plan limits;
  • reverse engineer, resell or redistribute the Service or its audio and visual content.

6. Intellectual property

Simranjit Singh Bhinder retains all ownership and intellectual property rights in the Service, including software, audio recordings, generated visuals, written content and branding. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, personal right to access and use the Service. Content you create (journals, presets, messages) remains yours; you grant us a limited licence to host and process it solely to provide the Service.

7. Service availability

We work to keep Medifest available and reliable, but we do not guarantee that the Service will be uninterrupted, timely, secure or error-free. Features may change, and we may add or retire content. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payments and subscriptions

Medifest is offered as a paid membership billed monthly or yearly, renewing automatically until cancelled. Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our reseller. Please see Paddle's Buyer Terms and our Refund Policy. You can cancel at any time; access continues until the end of the paid period.

9. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. On termination your right to use the Service ends and your content may be deleted after a reasonable export window.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the twelve months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury where it cannot lawfully be excluded, or your rights under the New Zealand Consumer Guarantees Act where they apply.

12. Indemnity

You will indemnify Simranjit Singh Bhinder against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. General

These Terms are governed by the laws of New Zealand and the courts of New Zealand have exclusive jurisdiction. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may update these Terms; material changes will be notified in-app or by email.
